PGPLANNING, S.L., with address at C/ Gremio de los Canteros nº 12-2º, Polígono Industrial de Hontoria, Hontoria (Segovia) and VAT nº B44558633 (hereinafter PGPLANNING), as the data processor of your personal data, informs you about the processing of your personal data.

PGPLANNING processes the data of individuals that use this Whistleblowing Channel (whistleblowers or informants) as a provider of software as a service, through which the company or entity receiving the reports manages these communications from informants (PGPlanning Software). In this regard, PGPLANNING acts as the data processor, while the company or entity to which the report is addressed is the data controller, responsible for processing personal data as described in the web form for the report or communication.

Purpose and legal basis for data processing: PGPLANNING stores personal data exclusively for the purpose of providing the data controller with the PGPlanning Software to manage its Whistleblowing Channel, based on public interest and the legal obligation imposed on the data controller, in accordance with Law 2/2023, of February 20, regulating the protection of individuals who report regulatory violations and combat corruption (which can be consulted here), as well as, where applicable, based on the legitimate interest declared by the data controller.

Data retention: Data is stored in the PGPlanning Software for the periods established by the data controller, which must comply with the timelines set forth in the Law. If the data controller ceases to use the PGPlanning Software for managing its Whistleblowing Channel, it may choose to download all data stored in the software up to that moment, related to received reports and their management.

While data is stored in the PGPlanning Software, it is hosted on a server located in Spain and is not subject to any international transfer by PGPLANNING.

Anonymous reports and data confidentiality: The PGPlanning Software allows whistleblowers to submit their reports completely anonymously. If the whistleblower provides their personal data, the software enables the data controller to handle the data with complete confidentiality and appropriate secrecy. Under no circumstances does PGPLANNING share data with any third party, except in cases provided by law.

The PGPlanning Software is designed to ensure that the management of the Whistleblowing Channel complies with the provisions of the Law and is carried out exclusively by the persons or roles designated in that law. However, it should be noted that the assignment of permissions for handling the Whistleblowing Channel is carried out by the company or entity to which the reports are addressed (the data controller).

Security: As required by the General Data Protection Regulation, PGPLANNING has conducted the necessary risk analysis regarding its data processing activities, adopting appropriate security measures to ensure the confidentiality, integrity, and availability of the data. Additionally, PGPLANNING enters into the relevant data processing agreements with its clients, outlining commitments to confidentiality, security, and other data protection obligations.

Your rights and complaints: We recommend that any request or complaint regarding your personal data be addressed to the company or entity to which you are submitting your report, as it is the data controller responsible for processing your personal data and managing received reports.
